A Power of Attorney (POA) is what makes remote buying real. Rather than flying to Kolkata to sign an agreement, register the deed, and take possession, you authorise a trusted person in India to do those specific things on your behalf. Used carefully, it removes the single biggest obstacle NRIs imagine — the assumption that you must be physically present.

What a Power of Attorney is

A POA is a legal document in which you (the "principal") grant defined authority to someone in India (the "attorney" or "holder") to act for you. For a property purchase, that authority usually covers signing the sale agreement, completing registration, and taking possession. The key word is defined — a well-drafted POA grants only the powers you intend, and nothing more.

General vs specific POA — use specific

There are two broad types, and the distinction matters:

  • General POA — broad powers across many matters. Convenient, but riskier, because it hands over wide authority.
  • Specific (or special) POA — narrowly scoped to a defined task, such as one property transaction.

For a single Kolkata purchase, a specific POA limited to that transaction is almost always the right choice. It gives your holder exactly the powers needed to complete the deal and nothing beyond it.

How to execute a POA from abroad

The general path, from your country of residence:

  1. The POA is drafted in India (by the lawyer we coordinate) to match your transaction and the registrar's requirements.
  2. You sign it before the Indian Embassy or Consulate in your country, where it is attested — or, in some countries, before a local notary followed by apostille/attestation.
  3. The signed document is couriered to India, where it is typically stamped and, where required, registered or adjudicated in the state before it can be used.

A protective POA is specific about scope. Typically it authorises the holder to:

Just as important is what you don't grant. Unless there's a clear reason, avoid giving powers to sell, mortgage, or lease the property, or to handle unrelated affairs. Keep it to the purchase.
